Yup, here is the archived comment by David Gift (http://list.msu.edu/cgi-bin/wa?A2=ind0711&L=msunag&T=0&P=16849) on the GMail TOS and his understanding of it.  I don't remember a posted response from him on his question to the General Council, I think he provided it in an IT Exchange session.  So if that's true, and the privacy was put aside, I'm not sure what the other reason(s) were for electing not to go with the Gmail solution.

What I remember was an issue with who owns the data that passes through the mail system.  Seems like the Google terms of service (TOS) said Google owned it, but then later it was commented it, I believe by David Gift himself, that the GMail TOS trumpted the Google TOS and that the individual owns the data.
 
However my memory has been incorrect in the past, just ask my wife.

Can somebody refresh my memory on why we decided not to move student and/or faculty staff email accounts to Gmail under Google's education offering?
