Yup, here is the archived comment by David Gift (http://list.msu.edu/cgi-bin/wa?A2=ind0711&L=msunag&T=0&P=16849) on the GMail TOS and his understanding of it. I don't remember a posted response from him on his question to the General Council, I think he provided it in an IT Exchange session. Seems like the Google terms of service (TOS) said Google owned it, but then later it was commented it, I believe by David Gift himself, that the GMail TOS trumpted the Google TOS and that the individual owns the data.
